1. Acceptance of These Terms
Welcome to the website of Earl’s Lawn Service. These Terms and Conditions govern your access to and use of www.earlslawnservicenky.com, including its pages, forms, content, features, and related services.
By accessing this website, submitting a form, requesting an estimate, contacting Earl’s Lawn Service, or otherwise using the website, you acknowledge that you have read and agree to these Terms and Conditions.
If you do not agree with these terms, please discontinue use of the website.
2. About Earl’s Lawn Service
Earl’s Lawn Service provides residential and commercial outdoor-property services in Northern Kentucky and surrounding service areas. Services may include:
Residential and commercial landscaping
Landscape design and installation
Lawn care and grass cutting
Mulching and bush trimming
Paver patios and stone firepits
Retaining walls
Sod installation
Yard regrading
Hardscaping
Property maintenance
Seasonal cleanups
Snow removal
The availability, scope, timing, pricing, and conditions of services may vary by property, location, season, weather, staffing, equipment availability, and project requirements.
3. Website Information Is General
The information presented on this website is provided for general informational and promotional purposes.
Descriptions, photographs, project examples, estimated timelines, service-area references, and other website content do not constitute a binding proposal, contract, guarantee, or warranty.
A binding agreement for services is created only when Earl’s Lawn Service and the customer approve a written estimate, proposal, work order, service agreement, or other written authorization.
If a written proposal or service agreement conflicts with these website Terms and Conditions, the signed proposal or agreement will control for that particular project.
4. Estimates and Proposals
Submitting a website form or requesting an estimate does not obligate Earl’s Lawn Service to accept or perform work.
Unless otherwise stated in writing:
Estimates are based on the information and property conditions reasonably available at the time of inspection.
Estimates may expire after the period stated in the proposal.
Pricing may change if the requested scope changes.
Pricing may also change if hidden, concealed, unsafe, or unexpected site conditions are discovered.
Materials, disposal, permits, delivery, equipment, labor, taxes, and subcontracted work may be charged as described in the applicable proposal.
Verbal discussions do not modify a written proposal unless the change is confirmed in writing.
Measurements, quantities, material needs, and project conditions may be adjusted after work begins when actual site conditions differ from what could reasonably be observed during the estimate.
5. Scheduling and Weather
Service dates and project timelines are estimates unless Earl’s Lawn Service expressly guarantees a date in writing.
Outdoor work may be delayed, rescheduled, interrupted, or extended because of:
Rain or storms
Snow or ice
Wet or frozen ground
Extreme heat or cold
Unsafe working conditions
Material delays
Equipment problems
Utility-marking delays
Permit or inspection delays
Supplier availability
Circumstances outside Earl’s Lawn Service’s reasonable control
Earl’s Lawn Service is not responsible for losses caused by reasonable weather-related or operational delays.
6. Customer Responsibilities
Customers are responsible for providing accurate information about the property and requested work.
Before services begin, the customer must disclose known conditions that could affect the work, including:
Underground irrigation systems
Invisible pet fences
Drainage systems
Septic systems
Utility lines
Landscape lighting
Private wiring
Buried pipes
Property-boundary concerns
Easements
Restricted areas
Hazardous conditions
Fragile plants or property features
Pets or animals on the property
Customers must provide reasonable access to the work area and remove vehicles, toys, furniture, decorations, hoses, pet waste, and other personal property that may interfere with the work.
Earl’s Lawn Service is not responsible for damage to concealed, unmarked, incorrectly marked, or undisclosed items that could not reasonably be identified before work began.
7. Property Access
By authorizing services, the customer grants Earl’s Lawn Service and its employees, subcontractors, suppliers, and equipment providers reasonable permission to access the portions of the property necessary to inspect, estimate, deliver materials, perform work, clean up, and remove debris.
The customer represents that they own the property or have authorization from the property owner to approve the requested work.
8. Utilities and Underground Conditions
When required, public utility-location services may be requested before excavation or digging begins. Public utility marking may not identify private lines or systems.
The customer is responsible for identifying or arranging the identification of private utilities and property features, including private electric lines, irrigation, lighting, drainage, septic components, invisible fencing, and similar installations.
Additional charges may apply when unknown underground materials, roots, rock, concrete, unsuitable soil, buried debris, drainage problems, or other concealed conditions affect the work.
9. Changes to the Scope of Work
Any work requested beyond the approved scope may require a written change order, revised estimate, additional payment, or schedule adjustment.
Earl’s Lawn Service may stop work until the customer approves the revised scope or price.
Changes requested verbally by the customer should not be considered approved unless Earl’s Lawn Service confirms them in writing.
10. Deposits and Payments
Payment requirements will be stated in the applicable estimate, invoice, proposal, or service agreement.
Depending on the project, Earl’s Lawn Service may require:
A deposit before scheduling
Progress payments
Material payments
Payment upon completion
Recurring payments for ongoing services
Customers agree to pay all approved charges by the applicable due date.
Unless prohibited by law or a written agreement states otherwise, overdue balances may result in:
Suspension of future work
Cancellation of scheduled services
Collection activity
Reasonable late charges
Recovery of permitted collection costs
Customers must promptly notify Earl’s Lawn Service of any invoice dispute and identify the specific amount and reason for the dispute.
11. Cancellations and Rescheduling
Cancellation and rescheduling policies may vary depending on the service, project size, materials ordered, crew scheduling, and agreement signed by the customer.
Deposits or advance payments may become nonrefundable when Earl’s Lawn Service has already:
Reserved labor or equipment
Ordered materials
Paid suppliers
Scheduled subcontractors
Obtained permits
Incurred other project-related expenses
Any cancellation fee or refund will be handled according to the applicable written proposal, contract, and governing law.
12. Recurring Lawn and Property Maintenance
Recurring services may be scheduled weekly, biweekly, seasonally, or according to another agreed frequency.
Service frequency may be adjusted because of weather, turf growth, seasonal conditions, property access, or safety concerns.
Unless otherwise agreed in writing, recurring service continues until canceled in accordance with the customer’s service agreement.
Missed service caused by locked gates, blocked access, loose animals, construction activity, parked vehicles, or other customer-controlled conditions may still be billable when a crew has been dispatched.
13. Lawn, Plant, Sod, and Landscape Conditions
Grass, plants, trees, shrubs, sod, and other living materials are affected by soil conditions, drainage, sunlight, weather, disease, pests, watering, fertilization, maintenance, pets, wildlife, and other factors outside Earl’s Lawn Service’s control.
Unless a written warranty expressly states otherwise, Earl’s Lawn Service does not guarantee:
Plant survival
Seed germination
Uniform turf growth
Sod establishment
Elimination of weeds, insects, or disease
Exact plant color, size, or appearance
Long-term drainage performance after surrounding conditions change
Customers are responsible for following watering, care, maintenance, and access instructions provided after installation.
Failure to follow care instructions may void any applicable written warranty.
14. Hardscaping, Grading, Drainage, and Settlement
Hardscaping, retaining walls, patios, firepits, grading, drainage improvements, and similar services may be affected by soil movement, freeze-and-thaw cycles, erosion, water flow, underground conditions, nearby construction, tree roots, and natural settlement.
Minor variations in color, texture, dimensions, joint spacing, surface appearance, and elevation may occur with natural stone, pavers, block, concrete products, soil, mulch, and other materials.
These natural variations are not necessarily defects.
Any workmanship warranty must be expressly stated in the written project agreement.
15. Snow and Ice Services
Snow and ice conditions can change rapidly. Plowing, shoveling, salting, or deicing services do not guarantee that a property will remain completely clear, dry, or free from slippery conditions.
Customers, occupants, visitors, and property managers remain responsible for exercising reasonable caution during winter weather.
Service timing, trigger depths, covered areas, materials, and pricing will be governed by the applicable snow-removal agreement.
16. Workmanship and Warranties
Any warranty offered by Earl’s Lawn Service must be stated in writing in the applicable proposal, invoice, or service agreement.
Unless expressly stated in writing, no additional warranty is created by website content, photographs, conversations, advertising, or prior project examples.
Manufacturer warranties, when available, are provided by the applicable manufacturer and remain subject to that manufacturer’s requirements, exclusions, and claim procedures.
Nothing in these terms excludes warranties or legal rights that cannot lawfully be excluded.
17. Photographs and Project Documentation
Earl’s Lawn Service may photograph or record work areas before, during, and after a project for documentation, quality control, training, insurance, portfolio, and marketing purposes.
Earl’s Lawn Service will make reasonable efforts not to display personal information, people, vehicle license plates, house numbers, or other identifying details in marketing materials.
A customer who does not want project photographs used publicly should notify Earl’s Lawn Service in writing before work begins.
18. Communications
When you submit a contact form, request an estimate, call, email, or otherwise provide contact information, you authorize Earl’s Lawn Service to respond regarding your request, estimate, appointment, project, account, or services.
Communications may occur by telephone, email, or text message when permitted by law and based on the information and consent you provide.
Consent to receive marketing text messages is not a condition of purchasing services. Message and data rates may apply. Customers may follow the opt-out instructions provided in a message.
Commercial text-message consent rules can be stricter than ordinary informational communications, so any separate marketing-text consent language should also appear directly beside the website form or checkbox used to collect that consent.
19. Acceptable Website Use
You may use this website only for lawful purposes.
You may not:
Attempt to gain unauthorized access to the website or its systems
Introduce malware, harmful code, or automated attacks
Interfere with website operation
Scrape or copy website content for commercial use without permission
Submit false, fraudulent, abusive, or misleading information

Earl’s Lawn Service reserves the right to respond to feedback and address statements it reasonably believes are fraudulent, unlawful, threatening, defamatory, or unrelated to an actual customer experience through lawful channels.
22. Third-Party Websites and Services
The website may contain links to third-party websites, maps, social media platforms, payment providers, scheduling systems, manufacturers, or other services.
Earl’s Lawn Service does not control those third parties and is not responsible for their content, security, availability, privacy practices, or terms.
Use of third-party services is subject to the provider’s own policies and agreements.
23. Website Availability and Accuracy
Earl’s Lawn Service makes reasonable efforts to maintain accurate website information but does not guarantee that all content will always be complete, current, error-free, or continuously available.

25. Indemnification
To the extent permitted by law, you agree to indemnify and hold Earl’s Lawn Service harmless from third-party claims, damages, or expenses arising from:
Your unlawful misuse of the website
False information you submit
Your violation of these terms
Your lack of authority to approve work at a property
This provision does not require a customer to indemnify Earl’s Lawn Service for Earl’s Lawn Service’s own negligence or conduct where such indemnification would be prohibited by law.
26. Governing Law
These Terms and Conditions are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law principles.
Any dispute will be handled in a court with proper jurisdiction and venue unless a separate written service agreement establishes another lawful dispute-resolution process.
27. Severability
If any provision of these terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
28. No Waiver
A failure by Earl’s Lawn Service to enforce a provision of these terms does not waive the right to enforce that provision later.
29. Changes to These Terms
Earl’s Lawn Service may revise these Terms and Conditions periodically.
The updated version will be posted on this page with a revised “Last Updated” date. Continued use of the website after an update constitutes acceptance of the revised website terms.
Changes to an already approved project or service agreement will not occur solely because these website terms are updated.
